Terms of Service

These Terms of Service ("Terms") govern your use of the DairyForge website, mobile application, and APIs (collectively, the "Service"), operated by DairyForge LLC ("DairyForge," "we," "us"). By creating an account, signing in, or using the Service, you agree to these Terms.
1. The service
DairyForge provides software for coordinating milk-hauling operations: dispatch, routing, driver mobile workflows, voice assistance, inspection records, wash events, and related operational tools. The Service is delivered as a hosted subscription. We may change, add, or remove features over time. We will give reasonable notice before removing a feature customers actively rely on.
2. Accounts
- You must be at least 18 and a commercial driver, dispatcher, plant operator, or authorized administrator to create an account.
- You are responsible for keeping your credentials confidential and for activity that occurs under your account.
- If your employer or customer organization administers your account, that organization may suspend or remove your access at any time.
- Notify us at security@dairyforge.com if you suspect unauthorized use of your account.
3. Acceptable use
You agree not to:
- Use the Service to violate any law or any third party's rights.
- Attempt to access accounts, data, or systems you are not authorized to access.
- Probe, scan, or test the vulnerability of the Service without prior written permission.
- Interfere with the Service's operation, including by uploading malware or sending excessive traffic.
- Reverse engineer, decompile, or extract source code from the Service except to the extent allowed by law.
- Resell, sublicense, or expose the Service to third parties without a separate written agreement with us.
4. Customer data
You retain ownership of the operational data your organization puts into the Service. You grant DairyForge a worldwide, royalty-free license to host, process, transmit, and display that data solely as needed to operate, secure, and improve the Service. We handle personal information as described in our Privacy Policy.
5. Intellectual property
DairyForge and our licensors own all rights to the Service, including the website, mobile application, source code, documentation, designs, and trademarks. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service while your account is in good standing. Nothing in these Terms assigns ownership of our intellectual property to you.
6. Fees
Where the Service is provided to your organization under a paid subscription, the fees, billing terms, and renewal schedule are set out in the order form or invoice between DairyForge and your organization. Individual drivers and dispatchers using accounts provisioned by their employer do not owe fees directly to DairyForge.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." DAIRYFORGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA WILL BE COMPLETE OR ACCURATE. DRIVERS REMAIN RESPONSIBLE FOR SAFE OPERATION OF THEIR VEHICLES AND COMPLIANCE WITH ALL APPLICABLE MOTOR-CARRIER REGULATIONS REGARDLESS OF ANY GUIDANCE PROVIDED BY THE SERVICE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAIRYFORGE'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOUR ORGANIZATION PAID DAIRYFORGE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS. DAIRYFORGE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUES, OR LOST DATA.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your account if you materially breach these Terms, create risk or possible legal exposure for DairyForge, or if your organization's subscription ends. We will give reasonable notice except where prompt action is necessary to protect the Service or other users.
10. Governing law
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Twin Falls County, Idaho, and you consent to the personal jurisdiction of those courts.
11. Changes
We may update these Terms from time to time. Material changes will be announced on this page with a new "Last updated" date. Continued use of the Service after the changes take effect constitutes acceptance.

DairyForge Operational Alerts
Program description
DairyForge Operational Alerts is an operational and transactional SMS program operated by DairyForge LLC. Messages are sent exclusively to the company's own drivers and dispatch staff — individuals employed by or under contract with a DairyForge customer organization in a role requiring shift coordination. Message types include:
- Shift sign-up confirmations and shift-change notifications.
- Dispatch alerts — new, modified, or cancelled milk-pickup routes.
- Call-off and coverage alerts when a driver or dispatcher calls off a shift.
- Shift-handoff summaries at the end of a driving day.
- Safety and compliance reminders (e.g., sanitizer, wash-bay availability).
- Time-sensitive coordination when phone or radio is unavailable.
This program is not a marketing or promotional program. No advertising or solicitation content is sent through this channel. Phone numbers collected for this program are never sold or shared with third parties for marketing purposes.
Message frequency
Message frequency varies. On an active driving day you may receive several operational messages; on days you are not on shift you may receive none.
Message and data rates
Message and data rates may apply. Your mobile carrier's standard rates apply to messages sent to or from your device. DairyForge does not charge you separately for participation in this program.
How to opt out
Reply STOP to any message from DairyForge at any time to unsubscribe. You will receive one confirmation message and will receive no further messages from this program unless you re-enroll.

Carrier disclaimer
Carriers are not liable for delayed or undelivered messages.
Privacy
Your mobile number and message records are handled in accordance with our Privacy Policy. We do not sell mobile numbers and do not share them with third parties except as required to operate the SMS program (e.g., our SMS gateway provider, Twilio).
